1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Athlete”, or “you”) and Spedaris Technologies LLP (“Spedaris”, “we”, “us”, or “our”), concerning your access to and use of the AuralFit mobile application and website (https://auralfit.fitness). By creating an account, downloading the app, or utilizing our services, you expressly agree to abide by these Terms.

2. Eligibility & Minimum Age

You must be at least 18 years of age to register an account and use AuralFit independently. Individuals aged 13 to 17 may use the service only under the direct supervision and with the express consent of a parent or legal guardian who agrees to be bound by these Terms. If you are under 13 years of age, you are strictly prohibited from using AuralFit.

3. Physical Activity, Health & Medical Disclaimer

IMPORTANT: PLEASE READ CAREFULLY BEFORE ENGAGING IN ANY PHYSICAL EXERCISE.

AuralFit provides algorithmic workout tracking, automated progressive overload recommendations, macro calculations, and AI chat coaching for educational and athletic fitness guidance only. AuralFit is not a medical organization and does not provide medical advice, diagnosis, or treatment.

Heavy resistance training, powerlifting, and cardiovascular conditioning carry inherent risks of severe physical injury or cardiovascular complications. You must consult a licensed medical physician prior to commencing any exercise program or dietary change. You agree that you voluntarily assume all risks of injury, illness, or damage associated with your workouts.

4. User Conduct & Gym Partner Safety

When interacting with other members via the Gym Match radar or spotter discovery, you agree to:

• Treat fellow lifters, spotters, and facility staff with mutual respect and professionalism.
• Never harass, stalk, threaten, or send unsolicited commercial advertisements or solicitation to other athletes.
• Never distribute, promote, or sell illegal anabolic substances, prescription hormones, or unapproved pharmaceuticals.
• Exercise personal judgment and safety precautions when agreeing to train with or spot an unfamiliar gym partner. Spedaris Technologies LLP is not responsible for the physical actions, conduct, or safety of users in third-party gym facilities.

5. Subscriptions, Payments & Cancellations

AuralFit offers a Free Starter tier alongside optional paid Pro and Elite memberships:

• Google Play Purchases: Subscriptions purchased through Google Play Store are processed, billed, and renewed according to Google Play policies.
• Cancellation: You may cancel subscription auto-renewal at any time via your Google Play account settings prior to the end of the current billing cycle.

6. Intellectual Property & Content Ownership

All software, interfaces, graphics, logos, exercise definitions, audio rest cues, and AI models embodied in AuralFit are the exclusive intellectual property of Spedaris Technologies LLP. You retain ownership of your personal workout logs and user-uploaded photos.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Spedaris Technologies LLP, its partners, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the application, inability to access the service, workout-related injuries, or interactions with workout partners found through Gym Match.

8. Governing Law & Jurisdiction

These Terms of Service and any disputes or claims arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. You agree to submit to the exclusive jurisdiction of the competent courts located in Surat, Gujarat, India for the resolution of all legal proceedings.
